Negative sexual offenses certificate
OBLIGATION TO PROVIDE THE NEGATIVE SEXUAL OFFENSES CERTIFICATE
WE INFORM OUR AFFILIATED CLUBS THAT THEY MUST MANDATORILY CARRY OUT THIS PROCEDURE, ACCORDING TO RFEF CIRCULAR NO. 42 OF THE 2016/17 SEASON.
On March 1, 2016, the Central Registry of Sex Offenders came into force, the body in charge of issuing the specific criminal record certificate on sexual offenses mandatory for any person working or intending to work or carry out any type of activity involving habitual contact with minors. These specifications are mandatory for these people in accordance with Organic Law 1/1996, of January 15, on the Legal Protection of Minors, modified by Law 26/2015, of July 28, on Child Protection, and by Law 45/2015, of October 14, on Volunteering.
It is a mechanism that facilitates the prevention, investigation and prosecution of these crimes and aims to prevent anyone definitively convicted from carrying out activities or exercising professions or trades in contact with minors.
Although since the entry into force of the Childhood Law in August 2015 it was already required to present this negative criminal record certificate and some educational centers had begun requesting them in their personnel selection processes, only since last March 1 can these specific certifications on sexual offenses be obtained.
REQUEST FOR THE CERTIFICATE BY WORKERS
This certificate is free and can be requested through different channels:
- Electronically through the Electronic Office of the Ministry of Justice, for which you must have a valid digital user certificate (electronic ID, FNMT).
- In person at the registries of the Territorial Managements of the Ministry of Justice, at the Citizen Service Center in Madrid, at the Government delegations and sub-delegations and at the registries of any administrative body belonging to the General State Administration, any Autonomous Community Administration, and any Local Administration.
- By regular mail addressed to any of the Territorial Managements or to the Citizen Service Center in Madrid.
By stating their mobile phone number on the application, the interested party will receive an SMS with a secure code to download the certificate as many times as needed from the Electronic Office of the Ministry of Justice.
THE CENTRAL REGISTRY OF SEX OFFENDERS
This Registry is regulated by Royal Decree 1110/2015, of December 11.
In it are recorded the identity and genetic profile data of persons convicted by final sentence for crimes against sexual freedom and indemnity and trafficking in human beings for sexual exploitation purposes, including pornography, whether adults or minors.
Minors will cease to appear in it once ten years have elapsed since they reached the age of majority. For these purposes, the cancellation of data related to penalties and security measures imposed in this matter is contemplated in Royal Decree 1110/2015.
